13 months damp problem

Question

Dear all.

The property to the rear of my apartment had a serious water leak over several months and has caused grave damage to my basement and back room.

I took the necessary steps in communicating this to my Insurance company, Syndicate and the owner of the property at the rear.

13 months have passed since the file was introduced by the insurance company. I have been in contact with them but they keep telling me they tried once to meet with the rear property owners but they never turned up to that meeting. They tried once! Other than that there has been little or no communication from all 3 parties other than to say they are aware of the situation.

I can no longer live like this as the damp toxins have spread throughout my home now. The toxins in the air have worryingly caused reoccurring bouts of bronchitis to both myself and my wife.

I’m writing one final letter as we speak to all 3 parties to take action but I fear again it will fall on deaf ears.

Have you any advice for me? Should I contact my solicitor and start something like court proceedings? Any advice or insight would be greatly appreciated.

Just to be clear, my syndicate is doing nothing about it – they have basically told me they have tried and there’s nothing more they can do. that I just need to wait. I’m lead to believe I must do my dealings through them, but 13 months later I’m still nowhere.

Please please assist with any knowledge/ advice no matter how small. Greatly appreciated. Thanks.

yes

Wait for legal advice first
> my syndicate is doing nothing
Sack them. Put forward a motion at the next annual tenant's meeting.

Ask this on www.pim.be - it's a better source of free legal advice on property matters than here. I've seen them answer questions in English befor if you can't manage French.
