buying a house on the name of my daughter
If you want to get a mortgage on the house - it will have to be in your name (and quite probably in your spouses' name also - I don't think you can borrow money in Belgium without agreement of husband/wife). If you want your 18 year old daughter to have her name on the house - then you would need to raise the mortgage on your current house - and pay the full amount for her house.
You'll need a solicitor to handle the sale anyway, so go and see one NOW.
There are 3 issues I can think of that complicate this:
- Inheritance
- Tax
- Mortgaging the property
None of which you should try to get round without professional legal help.
I don't think that Sarah is correct. I did buy a property in my daughter's name and we did get a mortgage. A lot will depend on the down payment you make. You do need to consider the inheritance factor, especially if your daughter gets married. Make sure that she has a marriage contract. Also if your daughter does marry and something happens to her your son-in-law may own the house. In any case I would discuss this with a notaire (not a solicitor) as he will be familiar with the inheritance laws. One possibility might be to put the house in your name and in your daughter's name jointly so that if anything ever happens to your daughter you own the house. But these are definitely questions you need to discuss with a notaire.
