Creche lied about O.N.E. accreditation

Question

Hello. My daughter started creche in March 2014. Before she started we had receieved an information pack from the creche that said they were with O.N.E and when we visited and I double checked with the owner she said yes, they were, no problem. The contrat also had the were with O.N.E. and even said we'd have to pay 7 euros to get the attestation fiscale.
Skip to this year and our request for an attestation got no response. Eventually after an unsatisfactory conversation with the owner I called O.N.E to find out they were last accredited in 2009.
Do I have any recourse? Could I sue them? The creche is 750 a month and we were anticipating at least a little back to make it less painful. My daughter is happy there and I'm sure the quality of care is good but this has left a bitter taste. I'm baffled too as to why they told such a stupid lie.

Unless you have something in writing ( or by email) that they claim to have ONE accrediation there is no point in challenging them...

A word of caution: Please make the payment by bank transfer ( even if they insist for cash).

We were disappointed, when we received the receipt for the payment only from bank transfer ---and not for the cash payments -

Thanks for answering, The creche information pack made the claim and the contract we had to sign to register our daughter also made the same claim.
I'm not sure what the payment is you're referring to.

We've only paid by transfer but it's a moot point anyway as the creche won't give us a receipt and we won't get any tax back.

I would think that you have to talk to ONE before doing anything yourself.
Obviously, if ONE are not interested you are unlikely to get much joy as a private individual. ('Woe is me! We accidentally gave Ms ABC an out-of-date information pack that should have been destroyed in 2010. How could such a thing have happened?' And so on.)
Another possibility is to talk to other parents and see what their attitude is. Are they aware of the situation? Were they attracted/impressed by the supposed O.N.E accreditation?

The police and commune have been in touch with the creche. They are in trouble. I called ONE to ask them the details of accreditation and an inspector called me back the next day with the details. They didn't suggest any action other than tell the commune. Quite a few parentls have withdrawn their child and the ONE inspector told me that a couple of parents who had called her on the same subject were livid. I know there's little we can do but I hope anyone reading this takes note and double checks accreditation with ONE or Kind & Gezin and doesn't just take the creches word.
The contract was signed with the date so they couldn't wriggle out of that one.

Your comment that 'the creche won't give us a receipt' makes me wonder whether the Tax authorities know of the business - or, possibly, just how much the owners are making out of it. I can't think of any other reason why they would not.
Telling the tax man would be a way to make sure that you DO get your own taxes reduced.

Sorry I was misleading. We've never been given a receipt actually. Should we be? By receipt I meant attestation fiscale. If we tell the taxman how would we get our taxes reduced?

Get your kid out ASAP. Most other parents will be doing the same thing. It will create a rush on other local creche places, so get in there first. The creche will go bust once this gets out. You will almost certainly have to take the creche to court to recover your deposit.
