Etat des lieux for thingy.

Question

We do not have an etat des lieux, the report was never made, the expert had personal issues thus now after 4 years there is still no report.

OK - Now I'm guessing that was the OP's question, and that's all there is to it.

1. There is a BUG on this site whereby if you use a title that has been already used, it will not allow your original question to be seen in full.

2. The law says you must have an état des lieux within a certain time limit (4 weeks?), and you have (another 8 weeks?) to correct it. This is not the case, therefore you have no état des lieux.
Therefore, it is impossible for the landlord to prove that you caused any sort of damage at all, so you will not be charged for anything, even if you practically trash the place (though I would recommend you leave it in good order)

Yeah, if you use a title that has already been used, the question links to the earlier question (in this case to one from Dec 2012!!). I've seen this a couple of times before. They should really fix it.

Thank you both for your quick replies.
One more thing, the apartment was brand new when we moved in, but not perfect, there were slight damages in paint and parquet.
Do you know if it matters that it was new?

It might do, as if the place is new and it's a first occupation, I think it is assumed to be perfect and therefore no état des lieux is required.

I'm not sure about that one. Best ask at www.pim.be
