just signed a contract
Hi,
A friend of mine i signed up for a new job ( 6 month probation period from Jan), joining date will be in Jan, he is a non-euro and is living in Belgium for the past 7 years.
Unfortunately in the past week he was informed by his doctor that his father living in India has advance stage of Cancer and he has a max of 6 month. He is under stress and is planning to inform the new company that he will have to move back and forth, support his family.
If the company does not accept his proposal the he does not mind giving up this job.
I want some advice from people familiar with HR matters.
1. Is his approach correct.
2. If the company does not accept his proposition, then he may not join the company, since he signed the contract, will they penalize him if withdraw his contract.
3. or should he keep quite, join the company and when time comes quit and attend to his family. since he will be on probation, i do not recollect the notice period required in such case.
Any advice is highly appreciated.

It's must be an awful situation for your friend.
My suggestion would be the following:
- contact the company and inform them about the situation. I would rather do it in a face to face meeting instead of by phone.
- the company could be comprehensive and try to find a solution for a certain period of time
This is of course the ideal solution.
- in case the company is not comprehensive, they might stop the contract during after 1 month of starting. For your information, neither the company nor the employee may stop the contract during the first month!!
- if the company stops the contract during the trial period, there is a noticeperiod of 7 days, which they will pay out or your friend has to perform the noticeperiod.
Concretely, I would suggest your friend not to quit the job but to explain the company this new situation.
Depending on how the company acknowledge the news, it's the company who has to take any initiative!!
This can be
1) find a solution so your friend can support his family
2) company put an end to the contract and has to give a 7 days noticeperiod only after 1 month!
