Landlord selling the appartment

Question

My landlord has announced that he is selling the appartment (after my living there just a few months). I immediately found a new place to live. He now tells me I have to fulfill my contractual obligations. Does this mean I am obliged to stay for the 6 months notice or face the normal 1,2,3 years penalty? What is my position? I dont want to lose the appartement I have just found.

well first of all you were not obliged to leave the apartment just because he was selling. A sale in Belgium usually require a good 3/4 months before the final contract is signed (Act d'Achat). only at this stage the new buyer gets ownership of the place and ONLY at this moment he can send you a letter to vacate the premises either to do renovation works or to live in the property himself. And has to give you SIX months notice.

So technically you could keep leaving in your current apt for a good 9/10 months as long as you have a rental contract, which could be a good idea to read it again because it should cover the aspect of a possible sale.
