No etat de lieu

I moved into an apartment 3 years ago and will leave shortly. When I arrived the landlord never did an etat de lieu, and I have emails showing that I asked him to do it.

I plan to clean the place thoroughly, and will also offer to pay for a sofa I have damaged, but what is the situation for the rest? The flat is not new, so a lot of the wear and tear was already there when I arrived. Does he have any right to keep the deposit?

Clean, yes, but DO NOT offer to pay for ANYTHING. If there were to be a dispute, your legal position is "I left the flat as I found it". The landlord cannot dispute that, given that there is no état des lieux. If you admit to having damaged something, you could undermine that, so don't shoot yourself in the foot and keep quiet.
