Rental agreement

Question

Hi there, flat mate wants to leave the flat that we have all signed to - what's the general situation regarding this? ANyone know?

I assume an amendment has to be made to the agreement?

Any impact on the actual rent amount? - does there have to be some form of agreement between the departing person and the person(s) remaining in the property (ie - anyone outstanding rent payments and bills for the usual gas, etc are paid by the departing person upto the date that they leave? So that an equal and fair amount is paid)?

Any personal bils/debts etc in the name of the person departing I assume will "go" with that person and any bills/debts etc in the name(s) of remaing person(s) will remain with them?

Difficult one and a lot of info I know !

Lots of different answers and questions for this one:
Was there a contract written at entry, signed by all occupants?
If yes, then this contract needs to be reviewed.
It would normally be the case that a set amount was agreed to be paid for the rent and the split as to how this total was met, should have been discussed and agreed by all occupants. Was this done?

The joys of sharing...

Basically, whoever's name is on the tenancy agreement is responsible for all the rent.

If he is a co-signatory, it would be his responsibility to sort out finding another sharer and covering the process of getting the names on the agreement changed, and he would also be responsible for coming to a suitable arrangement for any outstanding bills, including any damage that he might have caused that will come up in the état des lieux at the end of the tenancy.

That's an implied obligation. If he does a runner, then you are let to pay it all, make whatever arrangements need to be made yourselves, and then possibly take him to court to recover your losses.

If he's not a co-signatory, and you have no written co-tenancy agreement, then all you can do is hope that he does the above, as if he does do a runner, you have all the expense and no way of recovering it.
