TAX help!

Question

A couple living separately - but legally still married.
One left Belgium and is working in another EU country, the other's only income is a pension in Belgium.
does the income from the person working abroad needs to be declared in the Belgian tax declaration (which is still in the name of both parties) even if that person is not Belgian, no longer resident in Belgium and is paying tax at source (salary)..?

Ask your tax office, the address and telephone number are on the tax declaration form. That way you will get an answer that is correct for your precise circumstances. The fact that your ex is still named on the declaration form suggests that he/she is still registered in Belgium despite working abroad and that may complicate the issue, but your tax office will provide you with the correct answers.

You are, by the way, leaving it VERY late to sort this out even though you presumably intend to declare via TaxonWeb. Ask your tax office for an appointment tomorrow.

Most probably yes but will depend on when in tax year the break happened and also when person de registered

Your situation is known in French as a "Séparation de fait", i.e. you remain married, but live separately, and there is no formal separation agreement. There is guidance on the tax site for this: (See specifically note 4)

Whether you continue to need to file jointly, or can file on-line will depend on when you separated. As Becasse notes above - your best bet is to go and ask / get advice directly at your local tax office.
