Waiting for Residence Permit_Wanna go home for Christmas

Hello everyone,

I am a non-EU student, I have applied for a residence permit since 21 September and ever since there is nothing from the Commune (1000). I have gone there to ask and called them many times but they keep telling that I just have to wait. Apparently, that is the case for most of people here!
My problem is that my visa has expired, and I want to travel back to my country for Christmas. As it seems, I will have to wait much longer. :( I am totally desperate because I have already booked my tickets and I really wanna visit my family.

So, my question is: is it possible, as with my passport I can travel freely to Schengen Countries, to leave for Christmas and return back only on my passport or will I face any legal problems? I really wanna know if anyone is facing similar problems. I have a terrible communication problem with my commune.

Are you from an EU country? If yes, you can travel but take with you the temporary paper from the municipality proving that you are waiting for a residence permit + certificate from the university that you are student.
If you are not from an EU country and your visa has expired, do not leave Belguim as you'll not be allowed to come back.
